Terms and Conditions Oak Tree Property Portfolios Limited

Registered at 17 St. Mary’s Street, Malmesbury, Wiltshire, SN16 0BJ Company No. 06676359When you purchase property through Oak Tree Property Portfolios Limited, you are agreeing to our Terms and Conditions.

A. Our Relationship

1. You agree that as our client you will not approach a developer direct or attempt to purchase any property we send you details of except in accordance with the provisions of this Agreement. You must not use the confidential information or disclose it to any third party save in connection with a proposed purchase of a property using our services.
2. Oak Tree Property Portfolios Limited uses all reasonable efforts to ensure that the property details and information published in any marketing format, including email and website, is current, complete and accurate at the time of publication. Oak Tree Property Portfolios Limited make no express or implied warranties or representations as to the accuracy of all such information and will not accept responsibility for any errors, omissions, inaccuracies or misunderstandings arising out of any information provided in whatever format it may appear.
3. Oak Tree Property Portfolios Limited will not be liable for any damages arising out of or in connection with the use of any information provided in whatever format. Any property sales details published are produced in good faith and are not intended to form part of any contract
4. In compliance with our privacy policy, Oak Tree Property Portfolios Limited agrees not to pass your registration details on to any third party without your express permission. However, your details will be passed on to the recommended mortgage broker and solicitor on the reservation of a property.
5. The client should make your own searches and enquiries in relation to any property we supply information about. Oak Tree Property Portfolios Limited cannot be responsible for your decision to purchase or not to purchase a particular property or for the price or other terms on which you purchase any property. Under no circumstances will we be responsible for any losses or expenses you may incur as a result of purchasing or not purchasing a property we introduce to you.
6. We will not be liable for any failure to fulfill our obligations under the Agreement or delays in doing so due to circumstances beyond our control including without limitation:
   i. breakdown or malfunctioning of any equipment used by us
   ii. breakdown or malfunctioning of the World Wide Web or other communication links between us
   iii. external interference with information by hacking or otherwise
   iv. viruses affecting any communications between us.
7. Oak Tree Property Portfolios Limited activities include research of properties and locations, property sourcing, customer support and administration.

1. Oak Tree Property Portfolios Limited is not providing and will not provide any financial advice as regulated by the Financial Service Authority. You should always obtain your own independent legal and financial advice.
2. Property values can decrease in value as well as increase in value. We recommend you conduct your own due diligence exercise and take independent advice. At all times you must decide if property investment is suitable for your own financial and personal situation.

1. To reserve a property you must pay a Reservation Fee of £1,200 plus VAT, which at the current rate of 17.5% equals £1,410. These fees must be paid in full within 3 days of reserving a property. Reservations must be made in writing (post or fax) or by email. Failure to pay the full fees or longer than 3 days will result in the property being offered to our other clients.
2. In accordance with Industry Standards and practice, Reservation Fees are non-refundable in the event of the transaction not proceeding by the client.

1. You agree to use the services of the mortgage brokers/advisors introduced to you by Oak Tree Property Portfolios Limited when purchasing any property through us. You will be responsible for paying for your own survey and mortgage broker fees.
2. You agree to use the services of the independent solicitor introduced to you by Oak Tree Property Portfolios Limited when purchasing any properties through us. You will be responsible for paying your own legal fees, including Stamp Duty Land Tax, search fees, conveyancing fees and any other relevant disbursements.
3. After reserving the property you will use all reasonable efforts to progress the purchase and will deal with all communications from Oak Tree Property Portfolios Limited and from your mortgage brokers and solicitors as quickly as possible. You will provide us with such information as we request to enable us to help the purchase progress and agree that your mortgage brokers and solicitors will disclose any information as necessary.
4. Oak Tree Property Portfolios Limited will not be held responsible if you are unable to complete on a deal nor if you fail to meet any timescale imposed by the Developer. Under most normal conditions you should be in a position to obtain a mortgage offer and exchange contracts within 40 days of reserving your property.
5. If the purchase of a property does not proceed because of the developers or vendors withdrawal within the agreed timeframe for exchange or completion of contracts, we will refund any fees (excluding Reservation Fees and fees paid to third parties) within 30 days of your written request.
6. If for whatever reason you decide not to proceed with the purchase of a particular property in which case we reserve the right not to refund any fees you have made to us.
7. You may not assign this Agreement without our prior written consent.
8. Oak Tree Property Portfolios Limited may receive a fee or commission directly from the Developer or from the Seller of the property that you are purchasing.

1. Oak Tree Property Portfolios Limited may terminate the agreement at any time if in our absolute discretion we consider that you are in breach of the terms of this Agreement.

1. The whole of the Agreement is set out above and in these Agreement Terms. No other terms or representations apply to or are incorporated into the Agreement unless set out in writing and signed by you and by a Director of Oak Tree Property Portfolios Limited. No subsequent variation of the Agreement shall be effective unless set out in writing and signed by you and by a Director of Oak Tree Property Portfolios Limited.
